Abstract

This is a critical legal analysis of the Copyright Act 2023 that examines the changing dynamics between generative artificial intelligence (GenAI) and copyright law in Bangladesh. The Act represents a remarkable legislative development but falls short in addressing the implications of GenAI on the country’s copyright framework. Enacted during the booming period of GenAI advancements, the Act seems to have overlooked the growing intersection of artificial intelligence and copyright law. This article examines the Act’s limitations, in areas, such as “authorship”, “ownership” and “originality”, and explores the way outs. To keep pace with GenAI’s transformative impact on creative and intellectual outputs, this study advocates for further amendments to the Act especially in the suggested areas.
