Abstract | The evolution of artificial intelligence (AI) and its rapid integration into copyright frameworks pose significant disruptions to contemporary legal systems. Focusing on the “authorship”, “ownership”, and “compliance” aspects of AI-generated content, this paper presents a critical comparative legal analysis of the copArtificial Intelligence Act 2024 (EU AI Act). In Australia, the Copyright Act 1968 (Cth) reinforces the traditional principles of “originality” and “human authorship”, creating a regulatory gap for AI-generated content that impedes its legal protection and commercialisation. Conversely, the EU AI Act introduces a progressive approach, prioritising transparency, accountability, and lawful data usage, which indirectly influences copyright compliance. However, the absence of explicit provisions addressing copyright ownership for AI-generated content continues to create legal ambiguity. The study underscores the strengths and limitations of each jurisdiction, calling for establishment of a harmonised and flexible regulatory system capable of addressing the disruptions caused by AI while protecting copyrights. Such collaboration is critical for balancing innovation, ethics, and IP protection in today’s AI-driven world. |
